The Era, Sunday, April 23, 1871:
At Hammersmith Police Station on Tuesday, Mr Henry Froud, the landlord of the Queens Head public house, Sutton Lane, Chiswick, appeared to answer a summons which charged him with opening his house before one-o'clock on Sunday, the 26th ult.
Sergeant Marsh said about half past twelve o'clock on the day in question he saw a man who lived at Turnham Green leave the house. Witness found the door fastened. He knocked at the door, and it was opened by the defendant.
In the washhouse and back places witness found eighteen men concealed. Among the number was another man who lived at Turnham Green.
Witness found some beer in a pot which was concealed under a basket.
After hearing one of the men who lived at Acton, Mr Ingham said he was evidently a traveller, and he called for one of the men who resided at Turnham Green. Mr Martin, who defended, said that his client did not know either of the men. James Froud, the defendants brother, said he received instructions to ask all persons who required refreshments whether they were travellers. He did not know any of the persons who came on the Sunday. They all said they were travellers.
Mr Martin, with reference to the men who lived at Turnham Green, submitted that the police were bound to prove that the defendant knowingly served them. He then referred to a decision in point given by the superior Court last year. Mr Ingham said that in the face of the recent decisions of the Judges it was impossible to convict, and therefore he dismissed the summons. ***
